Abstract: The litigation strategy for financial business method patent is mainly studied from the perspective of patent value and disclosure. The value and disclosure of patent has a positive and significant effect on the probability of litigation. Furthermore, the disclosure of patent has a different effect on the probability of litigation with different patent value. When the patent value is relatively low, disclosure increasing will lead to increase the likelihood of litigation.
