Abstract: Abstract: The current enforcement system for patent license in China inclines to ensure the licensors’ control over patents while fails to harmonize and balances the benefits of both licensors and licensees. It not only entails institutional risks but also conflicts with other interrelated legal system. These problems are analyzed in details and possible institutional precautions are put forward.
