Abstract:     Abstract: License is the most important legal method in the usage of patent right. Patentee gives up the monopolization but obtains royalties. While licensee pays the license fee but obtains the right to implement the patent. The problem is that, if the licensee has the right to assign the usage right? The Chinese law does not regulate explicitly and the research on this problem is little. The reasonable and necessity of assigning the usage right are analyzed at some length, specific recommendations and measures for implementation are proposed. It might enlighten the comprehensive and thoroughly study on this issues.
