Abstract: With the combining of technology standard and patent,the technology standard's patent pool is becoming more and more important patent licenser.A perspective of developing country is adopted and the impact of technology standard's patent pool on self-determined innovation of China is analyzed.During the forming patent pool,the anticipation into the pool can strongly inspirit Chinese self-determined innovation,but also lead to overlap of R&D activity.On the other hand,the uncertainty of technology standard may hinder self-determined innovation.After formation of patent pool,it can improve innovation ability through promoting technology diffusion and spillover.At the same time,the intellectual property right misuse of patent pool as well as "free-riding" in the pool and the status of incumbents could block innovation.
