支持全面创新的知识产权基础制度的体系构建、内在机制与路径选择

摘要/Abstract

摘要： 党的二十大报告提出“加强知识产权法治保障，形成支持全面创新的基础制度”。知识产权基础制度能够为实现全面创新提供基本保障。本文首先提出支持全面创新的知识产权基础制度的内涵，随后构建支持全面创新的知识产权基础制度的体系，最后分析其内在机制并提出发展路径。支持全面创新的知识产权基础制度是能够支持体制机制创新、科技创新、管理创新和文化创新的知识产权权属制度、知识产权保护制度、知识产权实施运用制度、知识产权收益分配制度、知识产权资源保障制度的集合，具有必要性、长期性、根本性、普适性的特征。全面创新对知识产权基础制度形成需求拉动机制，知识产权基础制度通过基本规范系统、严格保护系统、高效市场系统、合理激励系统、有效保障系统支持全面创新。我国应建立健全知识产权所有权与实施权分离制度、知识产权基础性法律体系、知识产权法院体系、高校专业化技术转移机构建设制度、知识产权支出法定增长制度、复合型知识产权人才培养制度等。

Abstract: The 20th National Congress of the Communist Party of China proposed to "strengthen the legal protection of intellectual property rights (IPR) and establish a foundational system to support comprehensive innovation". The IPR foundational system provides critical guarantee for achieving comprehensive innovation. This paper first defined the connotation of the IPR foundational system supporting comprehensive innovation, and then constructed its system framework, analyzed its internal mechanism, and proposed future development pathways. The IPR foundational system supporting comprehensive innovation comprises the IPR rights ownership system, the IPR protection system, the IPR implementation and utilization system, the IPR benefit distribution system, and the IPR resource support system. Together, they provide comprehensive support for institutional and mechanism innovation, scientific and technological innovation, managerial innovation, and cultural innovation. The IPR foundational system supporting comprehensive innovation is characterized by necessity, durability, fundamentality, and universality. Comprehensive innovation drives the demand for the establishment of the IPR foundational system, which, in turn, supports comprehensive innovation through basic regulatory frameworks, stringent protection mechanisms, efficient market operations, reasonable incentive structures, and effective assurance mechanisms. To strengthen this foundational system, China should establish and improve systems such as the separation of ownership and implementation rights, foundational IPR laws, IPR court system, specialized technology transfer institutions in universities, legal growth regimes for IPR expenditures, and the training system for multi-skilled IPR professionals.
