Abstract: Abstract: As open innovation becomes the one of the mark for 21st century, knowledge appropriative behaviors of enterprises also change greatly, it is shifted from statically owning exclusive knowledge to dynamically getting rewards over sharing. The behavior triggers the organizational paradox, i.e. the coexistence of opportunity behaviors and cooperative benefits, as well as the disputation on the traditional Intellectual Property Right(IPR). Obviously, the emergence of new behariors needs the evolution of IPR. A concept of relational IPR is initiated, and furthermore practical examples of this new kind of IPR are provided. This research not only enriches theories about appropriability regime and knowledge governance, but also gives the strategic advices for enterprises who want to win in the open innovation.
