Abstract: According to classical theory in law and economics,there are two alternative mechanisms to protect personal entitlements,that is,either by property rule or by liability rule.The application of these two rules in the IPRs field and existing problems are analyzed.Based on the result,at first, a new kind of IPRs protection mechanism,i.e.,collective administration organizations of IPRs is investigared,and then its efficiency resting on intermediate quality between the two traditional rules is pointed out.Finally,its implication for public administration in general is revealed.
