Abstract: Based on regional index of market intermediary organization development and legal environment, and by means of manually collecting the patent data of listed companies, the research focused on the influence of regional legal protection on enterprise innovation by constructing the Tobit regression model. We found out that the protection of intellectual property rightsand the market organization service conditions significantly promoted enterprise innovation, which means that legal protection provides incentives for enterprise innovation; for state-owned companies, the effect of lawyers, accountants and other market organization service conditions on enterprise innovation is not obvious. That is to say, the state-owned enterprises have resources superiority in market service and are less subject to the constraints aspect; in the low degree of social trust, enterprise innovation depends on legal protection to a greater degree. This reflects the important role of the formal system of market development in the lack of social capital.
