The effectiveness about the compesation system for the patent infringement damage in China

Abstract: Based on the samples of the patent infringement cases judged and mediated by 42 courts in 23 provinces, municipalities, and autonomous regions, the empirical study is conducted to explore the effectiveness of patent protection involving the compensation system of patent infringment damage in China by using the multiple regression analysis model and t-test. The results show that the amount of claimed damage, patent type, region, and year variables have a significant effect on the amount of damage judged; the amendment of patent law, the nationality variables have an insignificant effect on the amount of damage judged; the amount of the statutory damage is closer to the amount of mediated damage. The conclusion of the study rectifies the non-objective findings in US 332 Investigation, and it also provides some references for China's policy-making.
