专利侵权诉讼中由于信息不充分和不对称，原告在证明经济损失、被告可得利润方面往往无法充分举证，因而法院酌定赔偿是专利侵权损害赔偿的常见形式。本文以行为主义为理论视角，运用多元回归方法对198份判决进行了实证研究。回归分析结果表明，专利技术复杂度、被告经济实力等非法定事实是影响法官裁判的重要因素。这是法行为学在专利侵权领域中对法教义学的一个挑战，揭示了专利侵权司法裁判的法官决策过程，对专利申请和诉讼的管理和行为决策提供了有益启示。

Due to insufficiency and asymmetry of information, the plaintiff are often unable to prove the economic loss or profit the defendant may get in the patent infringement litigation. Statutory damages is often adopt by the court. From the perspective of behaviorism, this paper makes an empirical study of 198 judgments using multiple regression analysis. It is found that some non statutory facts, such as patent complexity of technology, economic strength of the defendant would influence the judges This is a challenge on legal dogmatic in the field of patent infringement, which reveals the decision process of the judges, and provides beneficial enlightenment on management and decision in patent application and litigation.
