摘要：由于知识型服务业兼具服务业的一般特征及不同于其他服务行业的自身特点，因而其创新成果的有效保护成为其进一步成长的关键因素。本研究以理论分析与实证调研方式，通过对专利机制的制度分析结合对欧洲服务企业运用专利机制的数据与指标及中国的商业方法与相关服务专利现状的统计分析，得出专利机制对知识型服务业创新成果意义重大、其专利数量将大幅增长的结论。同时，利用Trend函数对2016年中国商业方法及相关专利数量进行趋势分析，并用二次曲线拟合模型对结论进行检验，把握专利机制对知识型服务业创新成果保护的未来。

Abstract: The mechanism of patent protection and the data related patent in service industry of Europe and China are analyzed, it is drawn a conclusion that mechanism of patent protection will be very important to the knowledge-based service industry. The number of service patent will grow rapidly in the future. Trend analysis on the business method patent in China is conducted and then the result is ralidated by a model of conic fitting. Grasping the importance of mechanism of patent to the knowledge-based service industry will promote its innovation and development, and also perfect IPR.
