摘要：中国现行专利实施许可制度侧重于保证专利权人对其许可实施专利权的控制，未能合理协调和平衡许可人和被许可人的利益，且与其他相关的制度相冲突，存在着制度性风险。本文就这些问题作了深入的分析并从制度层面上提出了完善的措施。

Abstract: The current enforcement system for patent license in China inclines to ensure the licensors’ control over patents while fails to harmonize and balances the benefits of both licensors and licensees. It not only entails institutional risks but also conflicts with other interrelated legal system. These problems are analyzed in details and possible institutional precautions are put forward.
