摘要：作为相关专利权人之间的一种战略性组织，专利联盟能较为有效地解决“反公地悲剧”问题和和规避专利丛林，同时放大了专利的作用，强化了专利权人的谈判地位和征收专利许可费的能力，甚至控制和左右相关专利技术的发展走向，给联盟成员带来了巨大的利益。我国企业需要深入了解和熟悉专利联盟的组织结构和运作机理，从而积极地应对国外专利联盟的市场竞争，同时也可以参与或组建自己的专利联盟组织，提高专利竞争能力。

Abstract: Patent pools, as the strategic organizations of related patentees, can solve the anti-commons problem more effectively and navigate the patent thicket. In the meantime, the pool raises the role of the patents, strengthens the negotiation position of the patentees and the power to impose patent licensing fees, as well as masters and influences the trend of related patent technology; and the members of the pool can gain enormous benefits from the pool. Therefore, Chinese enterprises should thoroughly understand and become familiar with the organizational structure and operational mechanism of patent pool in order to positively respond the market aggression from foreign patent pool, and participate in or set up own patent pools for raising the patent competitiveness.
