本文借鉴物理学中的电路原理,构建了一个专利联盟许可费分配的电路模型。在此模型中,联盟各专利对应电路中的各电子元件,联盟各专利之间的牵制和替代关系则对应电路中各电子元件之间的串联和并联关系。通过对电路模型的电路原理分析,本文提出:按照电路中各电子元件电压分布的比例关系来分配专利联盟中各专利间的许可费,是一种比较理想的"重质"的许可费分配模式。根据这一原理,通过对专利联盟开放性的考察,本文得到了一个能平衡联盟自身利益与激励技术创新之间关系的最优专利联盟模型。

Using the circuit principle of physics, a circuit model of patent pool is formed. In this model, each patent corresponds to an electronic element of the circuit, and the block and substitution relationship between the each patent in the pool correspond to series and parallel connections of the circuit. After analyzing the circuit principle of the circuit model, it is concluded that a distribution mode of license fee based on the proportional relation of voltage distribution for the each electronic element is a relatively perfect mode that lays stress on the quality. Then, by open reviewing the character of pools, a model of the optimal patent pool is obtained, which can balance the private benefit of the patent pools and the encouragement of the technology innovation.
