随着技术标准与专利的日益结合,技术标准下的专利池日渐成为举足轻重的专利许可主体。本文以发展中国家为视角,剖析了技术标准下的专利池对我国自主创新的影响。在专利池形成过程中,企业进入专利池的预期对我国自主创新有强激励作用,同时也可能导致重复研发。专利池所依附标准的不确定性也可能导致自主创新的迟滞。专利池形成之后,通过促进技术扩散和技术溢出,将有利于我国自主创新能力的提高。但另一方面,专利池的知识产权滥用行为则会对我国的自主创新产生消极影响。同时,专利池内部的“搭便车”行为和在位厂商地位也可能会妨碍创新。

With the combining of technology standard and patent,the technology standard's patent pool is becoming more and more important patent licenser.A perspective of developing country is adopted and the impact of technology standard's patent pool on self-determined innovation of China is analyzed.During the forming patent pool,the anticipation into the pool can strongly inspirit Chinese self-determined innovation,but also lead to overlap of R&D activity.On the other hand,the uncertainty of technology standard may hinder self-determined innovation.After formation of patent pool,it can improve innovation ability through promoting technology diffusion and spillover.At the same time,the intellectual property right misuse of patent pool as well as "free-riding" in the pool and the status of incumbents could block innovation.
