以23个省、自治区、直辖市的42家法院判决、调解的专利侵权案件为样本,采用多元线性回归模型及t检验法,对我国专利侵权损害赔偿制度是否有效地保护了专利,进行了实证研究。研究发现:请求赔偿额、专利类型、地区、年份变量对实际赔偿额的影响显著;《专利法》修改、国籍变量对实际赔偿额的影响不显著;法定赔偿额与调解赔偿额趋于一致。研究结果纠正了美国"332调查"中的不客观结论,对我国相关政策的制定与完善具有重要参考价值。
Abstract
Based on the samples of the patent infringement cases judged and mediated by 42 courts in 23 provinces, municipalities, and autonomous regions, the empirical study is conducted to explore the effectiveness of patent protection involving the compensation system of patent infringment damage in China by using the multiple regression analysis model and t-test. The results show that the amount of claimed damage, patent type, region, and year variables have a significant effect on the amount of damage judged; the amendment of patent law, the nationality variables have an insignificant effect on the amount of damage judged; the amount of the statutory damage is closer to the amount of mediated damage. The conclusion of the study rectifies the non-objective findings in US 332 Investigation, and it also provides some references for China's policy-making.
