专利申请提前公开对技术交易的影响研究

A study on the impact of early patent application disclosure on technology transactions

摘要:    在国家大力推动专利技术转化运用的背景下,专利申请提前公开能否通过缓解信息不对称问题以促进技术交易市场繁荣?本研究借助工具变量法,构建两阶段最小二乘回归模型,分析了专利申请提前公开同技术交易之间的因果关系。实证结果显示:专利申请提前公开能够有效缓解技术交易中的市场失灵,显著促进技术交易的达成。具体而言,专利申请提前公开对技术交易的促进效果更明显地反映在:复杂型技术领域的专利、国有企业所持有的专利以及经专利代理机构代理的专利。此外,专利申请提前公开促进技术交易的作用主要发生在专利申请授权之前,且集中体现于专利转让之中。基于研究发现,本研究分别从制度设计者、专利行政管理部门以及企业专利管理部门三个不同视角提出了针对性建议,为进一步优化专利制度设计与实施提供参考。

Abstract:    Against the backdrop of national efforts to promote the commercialization and utilization of patented technologies, this study investigated whether early patent application disclosure can alleviate information asymmetry and foster prosperity in the technology transaction market. Employing the instrumental variable method to construct a two-stage least squares regression model, this research systematically analyzed the causal relationship between early patent application disclosure and technology transactions. The empirical results demonstrated that early patent application disclosure alleviates market failures in technology transactions and significantly facilitates their occurrence. Specifically, its positive impact is more pronounced in patents within complex technological domains, patents held by state-owned enterprises, and patents represented by professional patent agencies. Moreover, the effect primarily manifests before patent grant and is concentrated in patent transfers. Based on these findings, this study will offer targeted recommendations from three perspectives: institutional designers, patent administrators, and corporate patent departments, and it will provide insights for optimizing the design and implementation of patent systems.
